An uncontested divorce is one in which both spouses have reached an agreement on all the major issues, such as property division, division of debt, child custody, child support, and spousal support.

 

A contested divorce in one in which the spouses cannot reach an agreement on the major issues and, as a result, the court will have to decide the final outcome on the disputed issues.

Grounds for a Texas Divorce

When you file for divorce, you must provide a reason why you are seeking to dissolve your marriage (also know as the "grounds for a divorce").  Texas law provides three no-fault grounds and four fault-based grounds for divorce.

No-fault grounds for divorce: 

  • Insupportability.  This means the marriage has become unsustainable because of discord between the spouses or a conflict of personalities and there is no reasonable expectation of reconciliation.

  • Live separate and apart for at least three years

  • Confinement to a mental institution for at least three years and there is no significant chance of recovery.

Fault-based grounds:

  • Adultery – must prove that the infidelity occurred and that it actually led to the breakup of the marriage.  Adultery is often difficult to prove since evidence of the affair must come from someone other than the spouses.

  • Cruel Treatment - This includes both physical and emotional abuse. However, proving emotional abuse in a court of law is much more difficult than proving physical abuse.

  • Abandonment - must prove that the spouse left the marital home, with no intention of returning and has remained gone for more than one year.

  • Felony Conviction - to use this ground, the felony conviction must have occurred after the spouses were married, it resulted in at least one year imprisonment and the conviction was not based on the other spouse's testimony.

The vast majority of divorces are based on no-fault grounds primarily because there is very little, if any, benefit to alleging a fault-based ground and often it brings even more emotional turmoil to an already stressful situation.  Additionally, because of the difficulty in proving most of the fault-based grounds, attorney's fees can skyrocket just trying to obtain the necessary proof.

How to File for Divorce Without a Lawyer

Texas Residency Requirements:

Pursuant to Texas divorce laws, at least one of the spouses must have lived in the state of Texas for a minimum of 180 days prior to filing a divorce action.  [Texas Family Code §6.301].

 

It’s not difficult to prove residency. For example, any one of the following items will establish residency - a valid state driver’s license, ID card, or voter’s registration card.

Divorce papers should be filed in the District Court in the county where either spouse has resided for at least 90 days. [Texas Family Code §6.301].

Child Support

Child support is set based on the state-mandated guidelines.  Using a Texas child support calculator is best for determining the amount of child support to be paid. The child support calculator uses the child support guidelines prescribed by Texas law. [Texas Family Code §§154.121, 154.122]. Legal custody refers to who makes or participates in the major decisions regarding the raising of the child.

Legal custody is determined based on what is in the child's best interest.

[Texas Family Code §153.002].

Joint Legal Custody is where both parents have the right to participate in making the major decisions affecting the child. 

Sole Legal Custody is where only one parent has the right to make decisions affecting the child.

In Texas, joint legal custody is presumed to be in the child's best interest unless proven otherwise. [Texas Family Code §153.001].

Physical Custody in Texas

Physical custody says who the children will primarily reside with and the other parent will have visitation as discussed below. 

In Texas, the non-custodial parent generally has the same visitation rights regardless of whether sole custody or joint custody is ordered in the divorce decree.  There are exceptions to this general rule of course, such as when there is a history of domestic violence.

Visitation

Visitation can be any schedule agreed upon by both parents and can be changed at any time provided both parents are in agreement. Basically, the parents are in control of visitation provided they both agree to it and it is in the best interest of the child. If the parents cannot reach an agreement on visitation then the court will require the parents to follow a specific schedule that is determined by the court.  The state provides guidelines on visitation and many parents find it easier to just go by the standard guideline visitation schedule. This will be explained in more detail in your divorce papers.

Detailed Answer: Texas has a mandatory 60-day waiting period that begins when the initial petition is filed.  This means the court cannot finalize any divorce until after this 60-day waiting period has expired.  However, the actual time it takes will largely depend on how quickly you and your spouse complete and file all the necessary paperwork and the judge's schedule.  Assuming there are no major hurdles, it is reasonable to expect your divorce to be finalized 65-90 days after filing the initial papers.

 

What documents are needed to file for divorce in Texas?
